This policy explains our privacy practices for Optra One Partner Application (the "App"), https://www.optra.one/ (which we'll refer to as the "Site") and any other services (together "Optra One") provided by AIRTH Research Private Limited, located at C-51/B, Rama Park, Uttam Nagar, New Delhi - 110059 India, referred to as "AIRTH," "we," "us" or "our".

This Privacy Policy ("Privacy Policy") applies to Users of the App, including the Site and any associated services (collectively, the "Platform').

User (hereinafter referred to as "you" or "your") includes: Individuals who accesses, views, and/or interacts with Optra One, Individuals or entity that registers on or uses Optra One and avails any and/or all Services made available through it, Third party partners or representatives associated with the use of Optra One, as may be determined from time to time, or Any business, including Sales and Service Dealers (SSDs), using Optra One

We collect, use and share your personal information as described in this Privacy Policy. We are only responsible for the information that we directly collect and process. We are not responsible for how other parties use your personal information, including those integrated with or linked to the Platform.

Our Terms and Conditions ("Terms") govern all use of our Services and, together with this Privacy Policy, constitute your agreement with us (the "Agreement").

This Privacy Policy is intended to provide clear and transparent information regarding how we collect, use, store, and protect personal data, and to outline your rights in relation to such data under applicable laws.

Our Privacy Policy

We process your personal information to run our business and provide our Users with the Services. By accepting our Terms as well as other policies, and in some jurisdictions, by acknowledging this policy, you confirm that you have read and understand this policy, including how and why we use your personal information. If you don't want us to collect or process your personal information in the ways described in this policy, you shouldn't use the Services. Optra One acts as a platform provider, and Users operate as independent data controllers with respect to personal information they collect or process. Accordingly, Optra One does not control or assume responsibility for how Users handle such personal information. We are not responsible for the content or the privacy policies or practices of any of our Users or third-party websites and apps.

Eligibility and Children's Privacy

The Platform is intended to be used by individuals who are at least 18 years of age.

We do not knowingly permit individuals below the age of 18 to register for or use the Platform. If we become aware that personal information has been collected from a person below this age without appropriate authorization, we reserve the right to delete such information and suspend or terminate the associated account.

Users are responsible for ensuring that all account activities are conducted in compliance with applicable laws and this Privacy Policy.

Information Collected or Received

In the course of operating and providing our Services, we may collect or receive your personal or business-related information in several ways: directly from you, such as when you register, complete forms, create an account, or otherwise interact with the Platform; based on your interactions with the Platform, including device, browser, and usage activity; from vendors and partners who support Platform operations such as customer support, infrastructure, and communication services, and from third party advertising and marketing partners, to the extent permitted by applicable law.

In many cases, you choose what personal information to provide to us. However, certain information is required in order to provide the Services or specific features. Optra One uses the personal information it collects and receives for the purposes described in this policy.

Automated Information

When you access or use the Platform, Optra One may automatically collect certain technical and usage-related information from your device, including: IP address Unique device identifier Cookie identifiers Browser type and settings Operating system and hardware model App version Page viewed, features used, interaction data App usage, performance, and diagnostic information

This information is collected automatically and stored in log files.

In some cases, Optra One may also receive similar information (such as IP addresses or device actions) from connected Internet of Things (IoT) devices, including voice-activated assistants or Smart TV, air quality monitors (AQMs), or other connected devices, where such devices interact with the Services.

We may combine automated information collected from your browser or mobile device with other information that we collect about you, or that is collected by our service providers, advertising partners, or marketing partners. This information is used to prevent fraud and to keep the Services secure, to analyze and understand how the Services work for Users, and to provide advertising, including across your devices, and a more personalized experience for Users.

Optra One may combine this information with other data collected directly or through service providers to improve functionality, ensure security, and support internal analytics. Optra One does not use such data to directly identify individuals unless required for legitimate business or legal purposes.

Registration, Account Setup, Service Usage

To access and use the Platform, Users are required to provide certain basic information, including a valid email address and account details.

Depending on the nature of use (including use by businesses such as Sales and Service Dealers), Optra One may collect additional information such as: Name and contact details Business name and business-related information Phone number Location or service-related details Product and service-related details

Such information is collected for the following purposes: Creating and maintaining User accounts Enabling access to Platform features and services Managing service workflows and operations Verifying account ownership Preventing fraud, misuse, or unauthorized activity Complying with applicable legal or regulatory obligations

Optra One may, where necessary, request additional information from Users to ensure compliance with its policies and applicable laws.

Profile

You may choose to provide additional profile information, such as a display name, location, or other details associated with your activity on the Platform. Certain information is publicly visible to other Users, including- Display name or business name Date of account registration Service-related activity or records created on the Platform (to the extent applicable) Feedback, ratings, or comments shared within the Platform (if enabled)

You can edit or remove optional profile information at any time through your account settings. We do not require Users to provide sensitive personal information to use the Services, and any optional information you choose to share is provided at your discretion.

Location Information

Optra One may collect approximate location information, such as city, region, or IP address, to operate, maintain, and secure the Platform.

Where enabled, the Platform may also process precise location data (such as GPS data) to support features including: Job tracking and technician assignment Operational visibility and service management

The collection of precise location data is optional and subject to device permissions. Users may enable or disable such access at any time through device or application settings.

Users are responsible for obtaining any necessary consents from their technicians, employees, or end customers prior to enabling location-based features, where required under applicable laws.

Optra One may share location data with third-party service providers only to the extent necessary for providing Platform functionalities.

Analytics Information

Optra One uses analytics and monitoring tools to operate, maintain, and improve the Platform.

These tools may collect information such as: Usage patterns and feature interactions Performance metrics Error logs and diagnostic data

Such information is generally processed in aggregated or de-identified form, where feasible, and is used to: Improve functionality and performance Enhance reliability and user experience Support internal analysis and product development

Non-User Information

Optra One may collect limited information relating to individuals who do not have a registered account, where such information is voluntarily provided or generated through interaction with the Platform. This may include: Contact details (such as email address or phone number) Basic technical information (such as IP address)

Such information is used solely for: The purpose for which it was provided Enabling Platform functionality (such as invitations or communications initiated by Users) Compliance with applicable laws

Account Visibility and Identification

The Platform is designed for business use and operational management. Optra One does not operate as a public social or marketplace platform.

Accordingly: User profiles are not intended to be publicly searchable beyond limited identification within the Platform; Any visibility of User information is restricted to what is necessary for operational use, collaboration, or service delivery; and Users may control certain display information through their account settings.

Optra One does not guarantee complete anonymity within the Platform where identification is necessary for legitimate business or operational purposes.

Communications from Optra One

Optra One may communicate with Users from time to time in connection with their account and use of the Platform. Such communications may be delivered via email, in-application notifications, or other available channels, and may include: Account-related information and confirmations Service updates and feature-related notifications Security alerts and important notices Customer support communications

Certain communications are essential for the operation of the Platform. By using the Platform, you agree to receive such non-marketing communications.

Where permitted under applicable laws, Optra One may also send optional communications relating to new features, updates, or offerings. Users may manage their communication preferences, including opting out of non-essential communications, through their account settings or by following unsubscribe instructions where available. Push notifications may be controlled through device settings.

A valid contact detail (such as an email address or phone number) is required to maintain an active account. Optra One may contact Users via such details for support, verification, or operational purposes.

User Interactions and Communication

The Platform may enable communication between Users for operational purposes, such as service coordination, job management, or customer interactions.

Optra One does not monitor or control the content of such communications and is not responsible for any information shared between Users.

Users are responsible for ensuring that any information shared through such communications complies with applicable laws and does not infringe the rights of any third party..

Information Uses, Sharing, & Disclosure

Optra One processes personal information to operate, maintain, and improve the Platform, and to enable its core functionalities. This includes: Managing user accounts and access Enabling service workflows, job management, and operational activities Providing customer support Maintaining platform security and preventing fraud or misuse Improving platform performance, features, and user experience Complying with applicable legal and regulatory obligations

Legal/Public Authorities:

We may be required to share your Personal Data Information with government or legal authorities and agencies for the purposes of verification of identity or for prevention, detection or investigation, including of cyber incidents, prosecution and punishment of offences, to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims.

Optra One does not sell personal information. Personal information is shared only in the manner described in this Privacy Policy and only to the extent necessary for legitimate business or legal purposes.

Sharing of Information:

Optra One may share personal information in the following circumstances:

  • With Service Providers: With third-party service providers who support the operation of the Platform, including: Hosting and infrastructure providers, Payment gateway providers, Communication and notification services, Analytics and technical support services. Such providers are authorized to process personal information only as necessary to perform services on behalf of Optra One and are required to implement appropriate safeguards.
  • Between Users (Operational Use): Information may be shared between Users to the extent necessary for operational purposes, including: Service coordination, Job assignments, Customer management. Users are responsible for using such information solely for legitimate business purposes and in compliance with applicable laws.
  • For Legal and Compliance Purposes: Optra One may disclose personal information where necessary to: Comply with applicable laws, regulations, or legal processes, Respond to lawful requests from authorities, Enforce its Terms and policies, Protect the rights, property, or safety of Optra One, its Users, or third parties, Detect, prevent, or address fraud, security, or technical issues
  • With User Consent: Where required, Optra One may share information based on User consent, including when optional features are enabled.
  • Business Transfers: In the event of a merger, acquisition, restructuring, or sale of assets, personal information may be transferred as part of such transaction. Optra One will take reasonable steps to ensure that such information remains protected in accordance with this Privacy Policy or a substantially similar framework.

Purpose Limitation:

Optra One processes personal information only for the purposes outlined in this Privacy Policy. Where processing is based on consent, Users may withdraw such consent at any time through account or device settings, subject to limitations relating to essential Platform functionality.

Third-Party Services:

This Privacy Policy applies only to information collected and processed by Optra One.

The Platform may integrate with or link to third-party services. Optra One does not control and is not responsible for the privacy practices of such third parties. Users are encouraged to review the privacy policies of such third-party services before sharing information with them.

Data Transfer:

Optra One may process and store personal information in locations outside the User's jurisdiction, including through third-party service providers.

By using the Platform, you acknowledge that your information may be transferred to and processed in jurisdictions where data protection laws may differ from those applicable in your location.

Optra One will ensure that such transfers are carried out in accordance with this Privacy Policy and applicable laws, and that appropriate safeguards are implemented where required.

Data Security

The security of your Personal Data is important to us. However, you understand that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to implement and maintain industry-standard security measures to protect your Personal Data from unauthorized access, loss, or misuse, we cannot guarantee its absolute security.

You are responsible for any breach to your privacy in case of negligence on your part, such as sharing of your login credentials with others or leaving your personal device(s) unattended while accessing the website.

We use appropriate technical and organizational measures to protect the Personal Data that we collect and process. These measures are designed to provide a level of security appropriate to the risk associated with the processing of your Personal Data.

Data Breach

We maintain appropriate security measures to protect your Personal Data. In the event of a personal data breach, we will take immediate steps to contain and mitigate the incident.

Where required by applicable law, we will notify the competent supervisory authority within seventy-two (72) hours of becoming aware of the breach, unless the breach is unlikely to result in a risk to your rights or interests.

If the breach is likely to cause harm to your Personal Data or affect your rights, we will inform you promptly with details of the breach, its likely consequences, and the measures taken or proposed to address it

Data Storage

Personal information collected through the Platform is stored on secure systems and infrastructure managed by Optra One or its authorized service providers.

Optra One takes reasonable steps to ensure that such storage complies with applicable laws and industry standards for data protection.

Data Retention

Optra One retains personal information only for as long as necessary to: Fulfill the purposes outlined in this Privacy Policy Maintain and operate User accounts Comply with applicable legal, regulatory, tax, or accounting obligations Resolve disputes and enforce agreements Maintain security and prevent fraud or misuse

Retention periods may vary depending on the nature of the information and applicable legal or operational requirements.

Where personal information is no longer required, Optra One will take reasonable steps to delete, anonymize, or securely store such information in accordance with applicable laws.

Closure of a User account does not automatically result in immediate deletion of all associated data, where retention is necessary for legitimate business or legal purposes.

Public Authorities Access Request

We respect the rules and laws of the jurisdiction in which we operate, as well as the privacy and rights of you. Accordingly, we have the following principles and procedure set up for responding to any disclosure request received from a public authority, including judicial authorities ("Public Authority") that involves your Personal Data as defined under applicable laws.

  • User Notification: Where permitted under applicable laws and not restricted by a binding legal order, we will make reasonable efforts to notify you before disclosing any of your Personal Data to a Public Authority. This allows you to take appropriate legal action, including seeking protective measures or objecting to the disclosure, where applicable.
  • Review of request's legality: We will carefully review the legality of any request from a Public Authority. If, after careful evaluation, we have reasonable grounds to believe that the request is unlawful under the laws of the relevant jurisdiction, or inconsistent with applicable obligations under international law, we reserve the right to challenge or decline such request.
  • Data minimisation: If a request is determined to be lawful and binding, we will ensure that only the minimum amount of Personal Data necessary to comply with the request is disclosed.
  • Record-Keeping: All requests received from Public Authorities and the corresponding disclosures will be documented and retained to ensure transparency and compliance with applicable laws.
  • Authorized Assistance: In responding to a request, we may involve authorized legal or technical experts to assist in fulfilling the request, subject to strict confidentiality and data protection obligations.
  • Protection of Rights: We will take reasonable steps to protect your rights and privacy to the fullest extent possible while complying with our legal obligations.

Your Rights & Choices

Users may access, update, or correct certain personal information at any time through their account settings. Optional information may be modified or removed at the User's discretion.

Users may also request account closure and deletion of their personal information, subject to applicable legal and operational retention requirements.

Depending on applicable laws, Users may have certain rights in relation to their personal information. Optra One will honour such rights in accordance with applicable laws.

  • Right to Access & Portability: You can access certain personal information associated with your account by visiting your User dashboard. You can request a copy of your personal information in an easily accessible format and information explaining how that information is used by emailing support@airth.in with "Data Request" in the subject line.
  • Right to Correct: You have the right to request that we rectify inaccurate information about you. By visiting your User dashboard you can correct and change certain personal information associated with your account.
  • Right to Restrict Processing: In certain cases where we process your information, you may also have the right to restrict or limit the ways in which we use your personal information.
  • Right to Delete: In certain circumstances, you have the right to request the deletion of your personal information, except information we are required to retain by law, or protect the safety, security, and integrity of Optra One, by emailing support@airth.in with "Data Deletion Request" in the subject line. You may request that we delete personal information we have collected from you and tell our service providers to do the same, subject to certain exceptions (such as where we are legally required to retain the information).
  • Right to Object: If we process your information based on our legitimate interests as explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your personal information for direct marketing purposes, you can object using the unsubscribe link in such communications or changing your account email settings.
  • Right to Withdraw Consent: Where we rely on consent, you can choose to withdraw your consent to our processing of your personal information using specific features provided to enable you to withdraw consent, like an email unsubscribe link or your account privacy preferences. If you have consented to share your precise device location details but would no longer like to continue sharing that information with us, you can revoke your consent to the sharing of that information through the settings on your mobile device. This is without prejudice to your right to generally permanently close your account and delete your personal information.
  • Right to Know: You have the right to request that we disclose to you: (1) the categories and/or specific pieces of personal information we have collected about you, (2) the categories of sources from which the personal information was collected, (3) the business or commercial purposes for collecting, selling, or sharing the information, (4) the categories of third parties to whom we disclose personal information, and (5) the categories of information that we sell or share, if any You can make a request to know up to twice a year, free of charge.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights. Unless permitted by applicable law, we will not deny you goods or services, charge you different prices or rates, provide a different level or quality of services, or suggest that you may receive a different price or level of service for exercising your rights. However, if certain personal information is necessary to provide the Services, deletion or restriction of that information may limit our ability to complete a transaction or provide specific features.
  • Jurisdiction Specific Rights: If you are located in a jurisdiction that provides the right to lodge a complaint with a supervisory or data protection authority, you may do so in accordance with the laws applicable to you. We encourage you to first contact us with any concerns so that we can try to resolve them directly.

We may take reasonable steps to verify your identity before processing your request and may deny a request if we are unable to verify your identity. You may designate an authorized agent to submit a request on your behalf, subject to appropriate verification, which may include a valid power of attorney and government-issued identification for both you and the authorized agent. We will use personal information provided in a verifiable consumer request solely for the purpose of verifying the requestor's identity or authority to make the request.

Email & Communication

Users may manage certain communication preferences through their account settings.

Optra One may send communications relating to the use of the Platform, including: Account-related notifications Service updates and feature changes Security alerts and legal notices Customer support communications

Certain communications are essential for the operation of the Platform and cannot be opted out of while maintaining an active account.

Users may opt out of non-essential communications, such as informational updates, by adjusting their account settings or using unsubscribe options where available.

If a User no longer wishes to receive essential communications, they may discontinue use of the Platform and request account closure.

Optra One Cookies & Similar Technologies Policy

Optra One uses cookies and similar technologies ("Cookie Technologies") to operate, maintain, and improve the Platform.

These technologies may be used for: Ensuring security and authentication Maintaining session integrity and user preferences Understanding platform usage and performance Supporting basic analytics and functionality

Cookies are small data files stored on a User's device that help recognize the device and retain certain information

Types of Cookie Technologies

Optra One may use the following types of Cookie Technologies:

Session Cookies: Temporary cookies that expire when the browser is closed

Persistent Cookies: Cookies that remain on the device until deleted or expired

Third-Party Cookies: Cookies set by service providers supporting Platform functionality

In addition, similar technologies may be used, including: Device or browser identifiers Application-level tracking for performance and diagnostics Limited use of analytics tools

Purposes of Use

We use Cookie Technologies for the following purposes:

  • Strictly Necessary (Security & Authentication) To maintain the security, integrity, and functionality of the Services, including account authentication and transaction processing.
  • Account Preferences & Functionality To remember User preferences, maintain login sessions, and customize content and settings.
  • Social Media Integration To enable interactions with third-party social media platforms. These technologies are governed by the respective third parties' privacy policies.
  • Performance & Analytics To understand how the Services are used, improve functionality, detect errors, and optimize performance. We may use analytics tools, including Google Analytics, subject to applicable policies and opt-out options.
  • Marketing & Advertising To deliver advertisements, measure campaign effectiveness, limit ad frequency, perform attribution tracking, support remarketing, and enable audience targeting or cross-device recognition. Third-party providers may collect device identifiers, IP addresses, or similar information to provide advertising and analytics services. These providers operate under their own privacy policies and are required to comply with applicable law.
  • Mobile Applications (SDKs) Our mobile applications may include third-party SDKs that collect information regarding app performance, usage, device information, and marketing interactions.

Legal Basis for Processing

Where required by applicable law, strictly necessary Cookie Technologies are used based on contractual necessity. Other Cookie Technologies are used based on consent or our legitimate interests in operating, improving, and marketing our Services.

Managing Your Cookie Preferences

You may control certain Cookie Technologies through: Your browser settings (to block or delete cookies) Device-level advertising settings (iOS or Android) Your Optra One account preferences Third-party opt-out tools, such as those provided by advertising industry organizations Google Ads Settings or the Google Analytics opt-out tools

Please note that disabling certain cookies may impact the functionality of the Services. You will continue to receive generic advertisements even if you opt out of interest-based advertising.

For IoT or other connected devices, please consult the device manufacturer for applicable privacy controls.

Exclusions

The Platform is intended for use by individuals and businesses that create accounts to manage their operations through it.

This Privacy Policy does not apply to personal information that Users (including businesses such as Sales and Service Dealers) independently collect, manage, or process outside the Platform.

Users act as independent data controllers with respect to any data they collect or manage through their own business operations. Any requests relating to such data should be directed to the relevant User.

Optra One is not responsible for the privacy or security practices of Users or any third parties outside the Platform.

Do Not Track (DNT)

Some browsers offer a "Do Not Track" (DNT) option that allows users to signal that they do not wish to be tracked online. We do not currently monitor or follow any DNT browser requests. However, we provide opt-out options for personalized ads and cookies, allowing you to manage your privacy preferences in accordance with this Policy.

Data Protection Officer

If required by applicable law, we may designate a Data Protection Officer (DPO) responsible for overseeing questions relating to this Policy. If appointed, contact details will be made available in the "Contact" section.

Privacy Policy Changes

We may amend or update this policy from time to time. If we believe that the changes are material, we'll let you know by doing one (or more) of the following: (i) posting the changes on or through the Services, (ii) sending you an email or message about the changes, or (iii) posting an update in the version notes on the Platform.
